ENTRY AND PARTICIPATION RULES FOR THE PEOPLE’S CHOICE TENANT AWARDS PUBLIC VOTING COMPETITION

1. GENERAL ENTRY CONDITIONS

1.1. The competition starts at 09:00 on 8 August 2025 and closes at 23:59 on 14 September 2025. No late entries will be accepted.

1.2.The competition is open to South African residents only.

1.3. Entrants must be over the age of 18 years.

1.4. The following persons are excluded from this competition and may not participate –

1.4.1 a director, member, partner, employee or agent of, or consultant to V and A Waterfront Holdings (Pty) Ltd ("V&A") or any other person who directly or indirectly controls or is controlled by V&A; and

1.4.2 a supplier of goods or services in connection with this competition; and

1.4.3 the spouses, life partners, business partners or immediate family members of a director, member, partner, employee or agent, consultant, supplier of goods or services in connection with this competition, or any other person who directly or indirectly controls or is controlled by the V&A.

1.4.4 V&A’s tenants and their staff, however they are encouraged to have their associates and customers enter by nominating and voting.

1.5 If you have won any V&A Waterfront competition within the last 30 (thirty) calendar days, you may not participate in this competition.

1.6 Only current V&A Waterfront tenants in good standing with lease obligations are eligible for nomination in the People's Choice Awards. Tenants who are under review or in breach of their lease agreements will not be eligible.

2. HOW TO ENTER

2.1 Phase 1: Entrants must nominate their favourite shop, eatery and small business at the V&A Waterfront, stating their reasons for the nomination, through a digital nomination form hosted on Webflow, the V&A Waterfront’s official digital nomination platform. All data will be securely collected and managed through Webflow’s form functionality. Entrants who complete the form qualify for a chance to win 1 x R1,000 (one thousand rand) V&A gift voucher in a random draw. Nomination phase runs from 09:00 on 8 August 2025 to 23:59 on 21 August 2025.

2.2 Phase 2: Entrants must vote for one of the Top 5 favourite shop and/or eatery finalists, to qualify for entry to win 1 x R5,000 (five thousand rand) V&A gift card voucher in a random draw. Voting phase runs from 09:00 on 26 August 2025 to 23:59 on 14 September 2025.

2.3. For public: Only one nomination in phase 1 and one vote in phase 2 per entrant will be accepted.

2.4. For tenants: Each tenant may only be nominated once per category in the People's Choice Awards.

2.5. All entries received that are incomplete, damaged, defaced, or illegible will be void and not eligible for entry into a competition.

3. WINNER SELECTION

3.1 All valid entries received during the nomination and voting periods will be automatically entered into two separate random prize draws for Phase 1 and Phase 2 of the competition, respectively.

3.2 The draw for Phase 1 will be conducted on 25 August 2025 using an automated random selection system administered by the V&A Waterfront team.

3.3. The draw for Phase 2 will be conducted on 17 September 2025 using an automated random selection system administered by the V&A Waterfront team.

3.4. Once each draw has been conducted, the selected winner will be contacted directly via telephone and/or email using the contact details provided in their entry. If the winner does not respond within 7 (seven) calendar days from initial contact, the prize will be forfeited and a new winner may be drawn at the V&A’s discretion.

3.5. Upon successful confirmation of the winner, their name may be publicly announced within 72 hours via the V&A Waterfront’s official social media platforms and other relevant marketing channels, at the organiser’s discretion.

4. PRIZES

4.1. Two prizes are on offer for the competition, 1 x R1000 (one thousand rand) V&A gift voucher for phase 1 and 1 x R5000 (five thousand five hundred) V&A gift voucher for phase 2 of the competition.

4.1.1. You may not win a prize if it is unlawful for us to supply such a prize to you. If you do win such a prize, you will forfeit it.

4.1.2. You must obtain and possess, at your cost and expense, whatever documents and permissions that may be required in order to accept and use a prize, and which documents and permissions must remain valid in such minimum form and for such minimum period after the prize date as may be required by the relevant authorities.

4.1.3. Unless we make alternative arrangements with the prize winner prior to collection of the prizes, the winner may collect the prizes from Mandla Mkhwebane or Asanda Njokweni in our Marketing Department at the V&A Waterfront Head Office between 8 am to 5 pm, Monday to Friday on business days during working hours, by appointment. In the event that you fail to collect your prize by 31st of January 2026, you will forfeit such prize.

4.1.4. It is your responsibility to provide accurate and truthful information on the entry form. If you are selected as a winner but, despite reasonable efforts, V&A is unable to contact you based on the information that you provided on the entry form, within 7 (seven) days from the day the winners are drawn, the V&A reserves the right not to award the prize to you.

4.1.5. The prizes are non-transferable and cannot be exchanged or converted to cash.

4.1.6. Proof of identity will be required to collect a prize and we reserve the right to refuse payment or handing over of a prize to any potential winner who refuses to, or cannot provide sufficient documentation to verify their identity.

4.1.7. We may require you to provide us with additional information as we may reasonably require in order to process and to facilitate your acceptance and/or use of a prize.

4.1.8. By accepting a prize, winners agree to participate in reasonable publicity including photography or/and social media mentions and possible press releases without additional compensation.

5. GENERAL RULES AND INFORMATION

5.1.You may obtain a copy of the competition rules from our website or from Asanda Njokweni in our Marketing Department at the V&A Waterfront Head Office between 8 am to 4 pm, Monday to Friday.

5.2 In the event of unforeseen circumstances or causes beyond our reasonable control, V&A reserves the right to cancel this competition, or to change the rules at V&A's discretion or to change the prize(s) at any time by publishing such decision on V&A's website: www.waterfront.co.za. It is your responsibility to check the Website from time to time for any such changes

5.3. The winner selection is final and no correspondence will be entered into.

5.4. Income and other taxes, if any, are the sole responsibility of the winner.

5.5. Each entrant agrees not to submit any entry that infringes any third party intellectual property rights, or any other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligations, or otherwise violates applicable law.

5.6. Any personal information (including, without limitation, your name, age, address, postal code, telephone number and/or e-mail address) that you submit on the entry form will be used solely in connection with this competition and will not be disclosed to any third party except for the purposes of the competition, where applicable, unless you agree otherwise, or unless disclosure is required by law or court order.

5.7. All entries become the property of V&A and will not be acknowledged or returned.

5.8. Neither V&A nor its directors, members, employees, agents or representatives shall be liable for any loss or damage suffered by participants as a result of participating in the competition, save where such loss or damage is a result of the negligent or intentional acts of V&A and/or its directors, members, employees, agents or representatives.

5.5. By participating in this competition, entrants grant V&A Waterfront the right to use any submitted content or materials (including but not limited to testimonials, photos and nomination messages) for promotional purposes in print, digital or PR platforms without additional compensation.
